Policy Questions for Council Consideration:
Should the West Linn Municipal Court be a Court of Record?
A request for Council to enact Ordinance No. 1583, establishing the West Linn Municipal Court as a Court of Record.
A Municipal Court of Record establishes efficiencies over court processes and determines which court has jurisdiction.
Local West Linn Municipal Court decisions would no longer be subject to review by the Clackamas County Circuit Court, and would be granted additional deference and would be reviewable by the Oregon Court of Appeals.
West Linn’s current Municipal Court operations meet some qualifications for a Court of Record, including judge’s membership with the Oregon State Bar, and audio recording capability.
The final, missing qualification is an establishing ordinance; enacting Ordinance No. 1583 would allow West Linn to meet all qualifications.
Staff recommends Option 1, enacting Ordinance No. 1583 establishing the West Linn Municipal Court as a Court of Record
