Ordinance No. 1581, Amending the Municipal Code Regarding Regulation of Noise

City Manager, at the request of the Chief of Police and the City Prosecuting Attorney
Policy Questions for Council Consideration:
Does the Council wish to amend Section 5.487 of the Municipal Code regarding sound levels and noise, the changes to: 1) remove the need for Police Department to use mechanical equipment to measure decibel levels,
2) put special permit requests under the authority of the City Manager, with potential for appeal to the City Council for a public hearing; and
3) generally streamline the existing code to make it a more effective tool to enforce maintenance of reasonable noise levels within West Linn?
The proposed changes would remove the need for the Police Department to employ noise meters and other technical equipment to measure the actual decibel levels of noise generators, instead providing clear and objective non-technical standards for the Police to effectively enforce
The proposed changes would make variances, or special permits requesting deviation from the noise standards, reviewable by the City Manager rather than the City Planning Commission, with the ability for parties to appeal that decision to the City Council for a public hearing
Adopt the ordinance making the proposed changes to Section 5.487 of the West Linn Municipal Code regulating noise and sound levels.
